Squaretrade won't return my device

I have a company called squaretrade I signed up for my phone. And I have sent it in. It has been some time . It's been since september. around the beginning of Oct said they would not approve the claim after it was approved already. After them receiving it ,took too long so I called and asked for an update. They said it was a problem with verifying and wouldn't be able to move forward . After that I told them I wanted my phone back and they had the audacity to say they will respond in two business days. Thr is never a response.l, two days then a week , and repeats. I've called in every other week with the same response. I want to get my phone back . Can I take then to small claims court to get it? Or any options possible to get it?
I'm in CA BTW but squaretrade is a national company I think.
