Question about total loss vehicle and insurance taking forever …

Our 10 year old minivan was in an accident in mid-August and we’re pretty sure it’s a total loss. After doing some research, we’ve discovered this insurance company tends to take the maximum time allowed to issue a cheque. We have some questions:

  1. We’ve already arranged to purchase a new vehicle. Our rental is supposed to go back next week, even though we’ve come nowhere near our $3000 limit and they have yet to come to a decision regarding our vehicle. If we no longer have the rental, can we removed the totalled vehicle from our insurance?
  2. Can we switch insurance companies while this claim is ongoing? They’ve already raised our rates because of the accident (literally the day we reported it) and we’re confident we can find cheaper insurance elsewhere.
  3. After the accident, they removed the vehicle to a wrecker in a town 3 hours away from us, even though there are lots of wreckers in the city we live in. We still had possessions in the vehicle. Is the insurance company responsible for returning our possessions?

@echo2788 There’s no fraud. They’re just assholes. They haven’t even sent an adjuster out to look at our vehicle yet and they keep insisting we return the rental even though we’re nowhere near our $3000 limit.

Yes, generally the day after the rental is returned. You have to have coverage up to and including the last day of the rental period. That said, when you say "remove" it kind of implies you have other vehicles. As long as your policy for other vehicles remains in place, as does the Loss of Use endorsement affording the rental, you probably could've cancelled it the day after the loss occurred. Your insurer will likely backdate the removal if that's the case. But if this vehicle were the sole vehicle on the policy, and the whole policy would be cancelled then the initial statement holds true.

That claim should not have impacted your rates until the following renewals, something doesn't add up there. But generally yes. That said, if this claim impacted your rates that suggests you were at-fault and didn't carry Accident Forgiveness, so are you sure you can find cheaper rates elsewhere?

They should've coordinated a date and time for you to gather those possessions, whether before or after moving it. In terms of it being 3 hours away, this may have been a costing saving measure. The ones closer to you may have been looking to charger a fee, or a higher fee than the one 3 hours away was asking.
 
@sovereignone We have accident forgiveness. Our driver ran a red light which caused the accident. We told the insurance that and they immediately raised our rates. This charge hasn’t even shown up on the driver’s abstract yet. The driver was listed on the insurance. The police attended the accident. There’s no question we’re at fault.

We know we can get lower rates because the driver who had the accident has moved out and is no longer on our insurance. We are now two adults in our 50s with perfect driving records. So we no longer need this shitty company for our teenaged drivers.
 
@jesseessej Then by that same logic you should then be able to notify your current insurer and let them know that driver had moved out and they should remove them as well.

And as you said, the charge is not yet on their abstract so they shouldn’t be rating for it. If it were me I’d be asking for that in writing and then pushing for backdated premium.
