Backed into by uninsured driver in California

Was at a stop sign and vehicle backed into me. All on GoPro. Man apologized and claimed to be homeless. This morning insurance called and said his policy lapsed from non payment I do not want to pay deductible as this was in no way my fault. Is there anything I can do? If this man is really homeless I don’t see how he is going to pay… this is so unfair

@resjudicata I take it you don't have uninsured motorist coverage. Ask your agent. Or adjuster.
