Auto, ON; Who’s insurance covers this?

My spouse was driving my car when the accident occurred. They’re at fault. They’re under the impression it goes through my insurance because it was my car. I thought it was through their insurance as they’re covered under their insurance for their vehicle.

Please advise who the claim needs to be processed through.

@doubtingdisciple Your insurance covers you. Theirs covers them. Ontario insurance is no fault in order to speed up the claims process by eliminating the need to negotiate with the at fault party's insurance. Call your own insurance company to initiate the claim.

@doubtingdisciple Who is they? Your spouse or the third party?

If you mean your spouse, then just because they have their own policy doesn’t mean their policy covers your vehicle. Their policy covers their vehicle, your policy covers your vehicle.

If you mean the third party, their policy covers them for their vehicle, and yours still covers yours.
