Would umbrella policy or H/O's insurance cover this?

@browndl Read your policy. The liability section generally covers 2 things: an occurrence that results in damage to someone's property or an occurrence that results in damages due to bodily injury. If a suit is brought because of a suit claiming property damage or bodily injury, your insurer...

    State Farm and my $0.02

@dixiegypsy31 If they sent out a claim payment letter and adjusters estimate, they are locked in at that number. Those aren't supposed to be sent until they are approved. Look up the term estoppel. If it was a field adjuster that sent you a copy of their estimate that wasn't approved by a desk...

Compelling action on at fault insurance bad faith delay?

@lyn244 From your source: "Standing To Sue It appears to be generally accepted that only an insured has legal standing to maintain a bad faith action, though it should be noted that this would presumably extend to any party qualifying as an insured (including additional insureds,) as opposed...

Compelling action on at fault insurance bad faith delay?

@lyn244 The remedy for the third party is the ability to sue. As previous stated, anything paid by the insurance company prior to a judgment is voluntary. Its the way the legal system works.

    State Farm and my $0.02

@dixiegypsy31 Was the homeowner issued a new claim payment letter/estimate with lower numbers? Claims aren't just handled willy nilly. Every payment and estimate is memorialized in writing. If the customer or contractor THOUGHT something would be covered but it wasn't approved, then that's a...

Why is O&P so controversial for GC’s?

@calledandchosen It's only some GC's that get crazy and make everyone look bad. They do off the wall stuff like try to claim O&P + supervisor hours on a residential project for electrical and drywall. If it's a true GC coordinating multiple trades, I'll be the first to say that O&P is...

Compelling action on at fault insurance bad faith delay?

@lyn244 Keywords. They owe good faith to their client for settlement of first party claims or defense of third party claims. This is not owed to a third party cause there's no contract between you and the insurer. All settlements are voluntary until a court orders it.

Compelling action on at fault insurance bad faith delay?

@lyn244 I don't think you understand bad faith. They don't owe good faith on a third party claim; you don't have a policy contract with them. If the claim is being investigated or they have a reason for delay, claims can take longer by notifying you once every 45 days.

water restoration cost has me baffled

@resjudicata Basically any claim involving water can bring in remidiation. It's almost impossible to say no. After a while you have to learn the coding for their services so they don't overcharge just by billing for service in "creative" ways.

Compelling action on at fault insurance bad faith delay?

@lyn244 You can't bring bad faith on a third party claim. They have a duty of faith to their insured who they have a contract with, not the third party.

Valuation and damage estimation when declaring a total loss

@redrider Progressive claim handlers and the estimators look at 25 or more vehicles a week, so they can tell when a vehicle is totaled. Paying a body shop to tear down the vehicle and write a repair estimate is a waste of money at that point. Is this was a 2021 year model, maybe, but for a 13...

Totaled my new Tesla Y with minimum insurance. What happens

@estherkinyua Moral of the story: If you wrecked into another Tesla just like yours, you couldn't cover the damage with your current insurance. Increase your limits.

Home was destroyed by massive tree in 80mph wind. Insurance has been like pulling teeth to make claim. Is this normal?

@hollywoodbowles So, a few pieces of advice. First, what specific thing are you trying to do right now? Your post isnt super clear. Going forward, when dealing with anyone in this claim, make your call to action is in the first sentence of any message you send. Then you can add the supporting...

state farm rental help??? total loss

@axiom1 Check your full policy for the exact terms. I normally see rental end 3 to 5 days after the vehicle is deemed as a total loss. If they didn't cut it off, people would just not purchase a new vehicle or delay the paperwork to give the insurance company the title/paperwork.

Insurance Sales Compensation: Am I getting screwed?

@roguesgloves Garbage. Find a new agency. The nice thing about a good commission compensation plan is that if you want a raise, you don't have to ask anybody for it; you just sell more.

    Car insurance screwing me?

@pennyrn Laws vary state to state, but where I am, third party losses are paid at actual cash value at the time of the loss. You vehicle would be valued and depreciation applied. Having receipts wouldn't really help as aftermarket parts depreciate horribly and often bring the value of a vehicle...

    Itemizing lost items

@thejoyfulfollower Ask you claim handler. They may have a contents inventory form they prefer. Generally more details are better but if they will accept basic info, it will save you the extra work especially if that work isn't needed.

(CA) Farmers home insurance "modified open perils"

@jordansomething Looks like it excludes losses from wind & hail and also limits losses from wildfires & smoke. That's the big differences I see at first glance.

    Calling a landscaper bond

@miguellox This sounds like a license bond. The obligee on those are normally the state or the state's licensing board for contractors. They basically guarantee the bond holder will follow all the laws of the state. License bonds don't normally cover worksmanship. You'd have to check with your...

Question on Residence Premises with Liberty Mutual ?

@nyki_t If your apartment is a "one or two family dwelling", then dwelling itself, other structures, and the grounds would be included in residence premises. If your apartment is not a "one or two family dwelling", then your residence premises is "that part of any other building where you...
