[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@resjudicata The job search being affected isn't and never was a qualifier. I promise, I have essentially memorized the UI section of the CARES Act and all of the UIPLs. Having to quarantine because a household member tested positive or is sick with COVID was a qualifying factor. Being...

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@april864 You need to stick to the fact that you gave all of this information and were told you qualified. And that requiring you to pay it back now would be "against equity and good conscience." Do some research here and on the web. If you have a lawyer, ask her for help (though most lawyers...

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@april864 Unfortunately you did not actually qualify for PUA. But it doesn't sound like you lied to get it. Your job search being affected is not actually a qualifying factor. Your best chance it to get a waiver.

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@april864 What was the basis you your eligibility for filing for PUA? Does the 2020 1099 cover any income from before you filed your claim? If it does, how did you get paid and what proof do you have?

[Illinois] Will I have to return my benefits?

@harris098 All of those facts are squarely in your favor. But like I said, if your contract co. argues that you failed to follow up according to procedure, that is the only issue. The reason and circumstances your F500 contract was terminated are largely immaterial. I had people get fired for...

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@april864 The 2019 W-2 would need to be earned income from employment, so that would not work. What was the basis of your eligibility for PUA? Do you have a 2020 W-2?

[Illinois] Will I have to return my benefits?

@harris098 They changed the rules to limit who can post and so the trolls aren't allowed to post any more. So now the only thing they can do to be annoying is downvote good posts.

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@scholiast https://dol.ny.gov/pua-documentation Tax Return Form 1040 SE or Schedule C - Your Form 1040 SE or Schedule C must be for the year prior to year you applied for PUA benefits. For example, if you applied for PUA benefits in March 2020, your Form 1040 SE or Schedule C must be for...

[Illinois] Will I have to return my benefits?

@harris098 Then you should be fine, BUT, if you didn't follow what ever rules they have about staying in touch, that is the only issue. But him telling you to look at the website, implies you were NOT fired by the placement company. If I was deciding your case, that would be enough to grant...

[North Carolina] Determined ineligible for benefits after job refusal and now must repay the state

@coloraydo That would be contrary ro federal law. The state can't force you to take a job that is unsuitable, meaning contrary to your morals or conscience, too far away, not within your skillset, etc. The problem in your situation is that it sounds like this job was indeed suitable and you...

[Illinois] Will I have to return my benefits?

@harris098 Being terminated from the Fortune 500 company is immaterial. You likely would not have been fired from the Contract Employer under those circumstances. You were likely terminated from the Contract Employer for not following up with them within three days and weekly regarding a new...

[North Carolina] Determined ineligible for benefits after job refusal and now must repay the state

@coloraydo Yep, it refers to your WBA not WBA + FPUC. You need to appeal and you can make an argument that the job was not suitable work. Look up you the qualifications in your state and see what fits. Unfortunately, it seems that you will likely lose this battle if you turned it down solely...

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@karac I actually, in 2 years have only seen 2 other situations like this. Most people have sole props or LLCs and the ones with corps mainly opted for PPP loans to cover their lost salary. Do some Googling because I do remember seeing some sort of guidance on a couple of sites about it. I do...

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@karac Normally, he should qualify, unless NY has some provision where he would not. Maybe talk to a tax professional that can help him know what exact docs show proof of personal employment income?

[ALL STATES] If you're a part-time W-2 worker whose only reduction in income came from gig side-work, how do you qualify for UI?

@sarsath THey are still working their customary hours on the W-2 job. They would need to have a reduction of those hours to qualify. The 1099 only comes into play with PUA and this person would qualify for Regular and therefore, not PUA.

[ALL STATES] If you're a part-time W-2 worker whose only reduction in income came from gig side-work, how do you qualify for UI?

@sarsath in the 2 W-2 job scenario, there is a reduction in hours relating to the wages reported to TWC. Different issue.

[NEW YORK] Some information about NYDOL and the Proof of Employment letters

@karac Here is the UIPL from the USDOL that gives some information. He can try sending in what he has and see what happens, but be aware that he may never have qualified and may have to pay everything back. Did he collect in 2021? Question: My state generally finds that a corporate...

    [New York] PUA Documentation Troubleshooter

@resjudicata NO. You gave the info they require. If you send the affidavit and they find it lacking in any way, they could reopen your file and find you ineligible for the entire claim.
